Terms of Use «NotifyMe»

1. Scope 

1.1 These Terms and Conditions of Use govern the acquisition and use of the application “NotifyMe” (hereafter app) by users and form an integral part thereof. 

1.2 The app is provided by Ubique Innovation AG.


2. Purpose

2.1 The purpose of the app is to notify participants (hereinafter referred to as users) of meetings, gatherings or events, if a certain incident occurs.

2.2 This app cannot be used for the mandatory collection of personal contact details, as it does not collect any personal data.


3. Conditions of Access and Use

3.1 The use of the app and its functions described in Section 4 is restricted to the territory of Switzerland.

3.2 By accessing the app, the user declares that he or she has understood and accepted the following conditions and legal information relating to the app (and the elements contained therein). If the user does not agree to these conditions, then the app is not to be used.


4. Functions of the app

4.1 Via the app, users are informed if they have attended a gathering where it subsequently emerges that at least one participant has tested positive for the new coronavirus and the risk of infection with Covid-19 was high.

4.2 The app fulfils the following functions using the hardware and operating system of the user's mobile phone:
At a gathering, the user scans a QR code that is displayed on site. To do this scanning, the camera of the mobile phone is used to read out the information of the QR code. By doing this, the user is checked in. This QR check-in code is generated in advance by the organiser of the gathering using a web app and is either printed out or displayed on a screen.
Upon check-in, an encrypted ID is stored locally on the user's mobile phone. The list of check-ins is only stored locally on the user's smartphone and is not sent to a central server. After 14 days, the local data is deleted. Check-ins can thus be displayed in the app for 14 days. This list is protected by a password. The display of entries can be removed at any time even before the 14 days have expired, without having to do without notifications.

4.3 If an infection of a participant of a meeting is proven, the person can report this to the organiser. A second, private QR code allows participants to be notified. To do this, the organiser must scan this second, private QR code. This triggers the publication of a decryption key on a server along with the time period relevant to the risk of infection. The app regularly compares the list of published keys with the encrypted IDs stored on the mobile phone. If a match is found and both the key and the time period match one of the entries on the mobile phone, the user receives a notification from the app. The notified participants are informed that they were potentially exposed to the coronavirus at a certain time in a certain place. They are not informed which user is infected.

4.4 The app does not use location tracking or geolocation.

4.5 The app uses the camera of the mobile phone.


5. User’s Duty of Care

5.1 Users are responsible for technical access to the app.

5.2 Users are required to take the necessary security measures to protect their own devices against unauthorised access by third parties and against malware. 

5.3 Users’ attention is hereby drawn to the security risks associated with use of the internet and of internet technologies.

5.4 Users are required to keep the app updated. There is no entitlement to use a specific version of the software.

5.5 Users are required to check any data they enter for completeness and correctness.

5.6 When using the app, users are responsible for complying with applicable legal provisions and the Terms and Conditions of Use. 


6. Liability and Warranty

6.1 While Ubique Innovation AG takes every care to ensure the correctness of the information, content and messages published on the app, no warranty can be given as to the correctness, accuracy, timeliness, reliability and completeness thereof.

6.2 Ubique Innovation AG expressly reserves the right, at any time, without prior notice, to partly or completely alter, delete or temporarily not publish information and content. 

6.3 Any claims for liability against Ubique Innovation AG due to material or immaterial damage, including consequential damage, arising for example from access to, use or non-use of the app and the associated information, content and communications, from misuse of the connection, from technical faults, or from infringement of the users’ duties of care, are hereby excluded. 

6.4 The user is responsible for and assumes the risks of any action or behaviour undertaken on account of information, content or communications in the app, e.g. self isolation/quarantine. Ubique Innovation AG will not be liable under any circumstances for any resultant damage. 

6.5 Liability for associates and third parties is excluded. 

6.6 Ubique Innovation assumes no responsibility and makes no warranty that the functions and use of the app will be permanently and continuously available and free of errors or faults, that errors will be rectified, or that the servers will be free of viruses or other harmful elements. 

6.7 Ubique Innovation AG is entitled to interrupt or discontinue use of the app at any time. 

6.8 Ubique Innovation AG is not responsible for the content of references and links to third party websites. Ubique Innovation AG assumes no liability for the continued existence, content or correctness of such information. Access to and use of such websites is at the user’s own risk. Ubique Innovation AG explicitly states that it has no influence on the design, content or offerings of linked-to pages. Responsibility for information and services provided by linked-to websites lies entirely with the third party in question. No responsibility whatsoever is accepted for such websites.


7. Data Protection 

7.1 The data protection aspects are listed in the separate privacy policy.


8. Termination of Use

8.1 Use of the app can be terminated by the user at any time by deleting/uninstalling it from the mobile phone. 


9. COPYRIGHT, Property Rights and Rights of Use

9.1 Copyright: Ubique Innovation AG. 

9.2 The information and contents are made available to the public. The contents published by Ubique Innovation AG in the app may only be used for personal use. Any reproduction or transfer of the content to third parties beyond this is not permitted. Downloading or copying content, images, photos or other files does not transfer any rights regarding the content.


10. Final Provisions 

10.1 Ubique Innovation AG reserves the right to change and amend the terms of use at any time. The new conditions will be communicated to the users in advance and in an appropriate manner and are deemed to be approved without objection within one month.

10.2 Should any provision in the Terms of Use be void or ineffective, the Terms of Use shall not be affected in general.

10.3 Swiss law is applicable. The place of jurisdiction is Zurich.

Privacy Policy of Ubique Innovation AG in connection with the use of the «NotifyMe» App

1  Collection and Processing of Data 

The app system has two components:

• a system for managing check-ins, consisting of software installed by users on their mobile phones and a corresponding backend. This system (app NotifyMe) also accesses the device's camera to read out the information stored in the QR code. No photos are taken.

• a system for generating QR codes for check-in as well as QR codes for triggering notifications, consisting of a web app and a corresponding backend.


The following data is stored locally on the mobile phone:

• the random IDs generated by scanning the QR check-in code with the time and date of check-in and check-out and the data from the QR code.


The responsible person of the organiser can scan the QR code to trigger the notifications ("decryption key"). This process saves the following data in the backend: 

• the decryption keys with the check-in and check-out time of the events for which a notification was triggered.


In addition, common server logs are recorded in the backend for technical reasons, e.g. when accessing the NotifyMe website when creating the QR codes.

2 DURATION OF DATA RETENTION

The data are destroyed as soon as they are no longer necessary for the notification of the users. Specifically, they will be destroyed as follows: 

• the data of the system for managing the check-ins (both on the mobile phones and in the backend): 14 days after they are recorded

• the decryption keys transmitted by the organisers with check-in and check-out times (in the backend): 14 days after transmission

3  Amendments 

Ubique Innovation AG may amend this privacy policy at any time without prior notice. The current published version or the version valid for the respective period shall apply.
